澳大利亚修订新轮胎进口条件

 10月8日,澳大利亚农林渔业部(DAFF)发布85-2013号进口通关通告,向所有新轮胎进口企业发布了新修订的新轮胎进口条件。 

    在有报道称未用全封闭式六硬面集装箱(软/开顶集装箱、框架箱、拼箱、杂货箱和空运)运输的新轮胎与现行通关程序相矛盾后,DAFF对现行新轮胎进口条件进行了审核。最终,DAFF针对上述新轮胎发布了新进口条件。此外,对现行新轮胎进口条件进行了修订。

    出口到澳大利亚的由全封闭式六硬面集装箱运输的新轮胎被认为生物安全风险小到无,并且对这些新轮胎的到岸干预水平应与其风险相一致。所有其他进口途径,包括软/开顶集装箱、框架箱、拼箱、杂货箱和空运由于暴露于受关注的生物安全污染中而被认为具有较高生物安全风险。

    以前规定所有新轮胎进口要求的新轮胎进口条件被拆分为两个不同的进口条件。一个进口条件适用于由全封闭式六硬面集装箱运输的新轮胎,该运输方式使轮胎在途中被污染的风险最小。另一个进口条件适用于由软/开顶集装箱、框架箱、拼箱、杂货箱和空运运输的轮胎,这些运输方式由于暴露于污染中而使轮胎被污染的风险增大。

    DAFF除了基于进口途径将现行进口条件拆分为两个单独的进口条件外,还对每个进口条件进行了修订。

    新进口条件的主要修订内容如下:

    一、由全封闭式六硬面集装箱运输的新轮胎进口条件 

    1.对每批货物须随附的说明“这些轮胎干燥、不带蚊子的卵和幼虫、不带受关注的生物安全污染,并且出口前一直隐蔽储藏”的货物特别声明进行的修订包括:

    (1)增加措词“不带受关注的生物安全污染”;

    (2)要求声明上包含货物的发票和集装箱号/数量;

    (3)声明可以由出口商或供货商提供。

    2.修订后的进口条件澄清以拼箱和空运方式进口的新轮胎包含在“新轮胎(未用全封闭式六硬面集装箱运输)”进口条件的适用范围内。

    3.修订后的进口条件确认不适用于新实心轮胎。

    4.修订后的进口条件详细规定了如果在随机检验过程中发现受关注的生物安全污染时需采取的检验程序。

    5.修订后的进口条件包括对入境管理信息的修订。

    6.修订后的进口条件删除了处理选项 T9986(高压蒸汽灭菌),该处理方式11不再与此类货物相关联或用于此类货物。

    二、新进口条件“新轮胎(未用全封闭式六硬面集装箱运输)”规定了通过使轮胎具有潜在受污染风险的途径(软/开顶集装箱、框架箱、拼箱、杂货箱和空运)进口的新轮胎的检验和处理要求。

    通过这些途径进口的新轮胎适用现行的到达后检验要求,此外,生物安全检验人员将对轮胎中发现的任何水进行取样和检验。该取样需要采集可能存在的风险数据,以协助进一步评估与进口轮胎相关的风险。

    将有一个过渡期使利益相关方有时间知悉相关修订内容并做出必要的改变。修订后的进口条件将自 2013年12月1日起生效。

Background

A review has been conducted following reports of inconsistencies with the clearance process for new tyres that are NOT shipped in fully enclosed six hard side containers (soft/open top containers, flat racks, LCL, break bulk and airfreight). As a result, a new ICON case has been published for these tyres. In addition, the existing ‘New Tyres’ ICON case has been amended to reflect the changes.

It has been recognised that new tyres exported to Australia in fully enclosed six hard side containers pose little to no biosecurity risk and the level of onshore intervention should reflect a suitable response to the risk posed.

All other import pathways, including soft/open top containers, flat racks, LCL, break bulk and airfreight are considered to present a higher biosecurity risk due to their exposure to contamination of biosecurity concern.

What has changed?

The New Tyres ICON case that previously set out the import requirements for all new tyres has been separated into two distinct cases. One case deals with tyres shipped in fully enclosed, six hard sided containers, where the risk of the tyres becoming contaminated en route is minimal. The other deals with tyres shipped in soft/open top containers, on flat racks, LCL, break-bulk and airfreight consignments, where the risk of contamination through exposure to the elements is increased.

Apart from separating the existing ICON case into two separate ICON cases based on import pathways, the following changes have been made to the individual ICON cases.

Changes to the ICON case ‘New Tyres’, specific to new tyres shipped in fully enclosed six hard side containers, are as follows:

  • Changes to the consignment specific declaration stating that ‘the tyres are dry, free of mosquito eggs and larvae, free from contamination of biosecurity concern and that they have been stored under cover until the time of export’ that must accompany each consignment include:
    • the addition of the wording ‘free from contamination of biosecurity concern’,
    • the requirement for the invoice and container number/s specific to the consignment to be included on the declaration and,
    • enables the declaration to be provided by either the exporter or supplier
  • The revised case clarifies that consignments of new tyres imported as LCL and airfreight are covered by the ICON case entitled ‘New Tyres (NOT shipped in fully enclosed six hard side containers)
  • The revised case identifies that the conditions are not applicable for the commodity; new solid tyres
  • The revised case details the inspection process that will be required if contamination of biosecurity concern is detected during random inspections.
  • The revised case includes amendments to Entry Management information which reflect the changes
  • The revised case removes treatment option T9986 (Autoclave) which is no longer relevant or used for this commodity.

The new ICON case, “New Tyres (NOT shipped in fully enclosed six hard side containers) outlines the inspection and treatment requirements specific to new tyres imported via a pathway where there is potential for the tyres to become contaminated. (Soft/open top containers, flat racks, LCL, break bulk and airfreight).

Consignments of new tyres imported in these ways are subject to existing on arrival inspection requirements, with the addition that any water that is detected in the tyres will be sampled and inspected by biosecurity inspectors. This sampling is required to capture data on the risks that may be present to assist with further assessment of the risks associated with imported tyres.

When will this industry notice become effective?

There will be a transition period to allow for clients to be informed of these changes and implement the necessary changes. Therefore, the revised import conditions will come into effect as of 01 December 2013.
